Nicholas Brayne

Nicholas is an award-winning communicator having worked across many sectors. Over twenty years in front line representation, he has assisted parties in medical, professional, property, commercial, negligence, reputational, political and contractual negotiations. Nicholas has worked with several high-profile clients in sensitive discussions, including mergers and acquisitions.

Nicholas started his career within broadcasting, holding a series of senior positions in leading global media brands. A decade ago, Nicholas refocused on business, specialising in formats, rights development and M&A negotiations. This consultancy developed into delivering conflict resolution solutions and crisis management. 

He has provided consultancy services to Senior Executives, when their businesses are experiencing a point of crisis or facing insolvency proceedings. In addition, he has negotiated resolutions in both B2B and B2C complex situations, including for companies facing difficulties in the Covid-19 pandemic. 

Nicholas has delivered cross-border mediation and consultancy support services globally, with a focus on the US, Europe and the Indian Subcontinent. He has won several awards for his body of work. In addition, his community endeavours and charitable work has been recognised by the UK Government and The British Royal Family. 

Away from work, Nicholas has a deep passion for travel, music, sport and history.

The Mediation Process

A commercial mediation typically runs over a single day. The process is personable, voluntary, confidential and aimed to help parties to come to their own agreement. It is beneficial for both parties to enter the process with a willingness to find an agreeable outcome and work constructively. The process is governed by a mediation agreement, which all parties and the mediator sign. 

Throughout the day, the mediator holds a combination of joint sessions (with both parties) and private sessions (with the parties individually). The format is flexible and can be tailored to help both parties and the mediator reach a beneficial outcome.

Resolving disputes through dialogue

We all experience conflict and disagreements in our lives. Some will be challenging and difficult to resolve. It is how we deal with conflict that matters. Importantly the mediator is independent and impartial, therefore enters the process without preference or prejudice.

 

The sole role of a mediator is to support the parties in finding a way forward. The parties are always in control of the process – and the terms of any agreement that might be reached. The process is designed to help the parties find solutions for themselves, without the stress and costs of court proceedings or a tribunal.

How Mediation Works

Conflict can be stressful and distracting. Unresolved issues can escalate, be time-consuming and costly. Ultimately,

un-addressed problems can be referred to the courts, incurring significant expense and potential reputational damage. 

As a mediator, it is my role to identify the root causes of conflict and help guide parties to identify their own remedy".
